COPYRIGHTS AND TRADEMARKS

You’re entirely responsible for how you combine Content with any other images, graphics, text or other items you include in your products. You agree that you won’t include any text, image, design, trademark, service mark, or any other type of copyrighted work of a third-party into your products unless you’ve received the proper authorization from the owner(s).

You agree that your products don’t violate any rights of any third parties (including copyrights, trademarks, right of publicity/privacy) and also won’t libel or defame any third party, and that you’ve acquired the needed rights and/or permissions to incorporate any third-party content into your products.

By placing an order through this site, you acknowledge that you’ve got all the necessary permission, right and authority to make such an order, and also that you grant TycoonPackaging.co.uk™ the right to manufacture the products on your behalf.

CUSTOMER CONTENT

You are entirely accountable for the use of Content in conjunction with all images, designs, graphics, texts or other materials you combine into your products. You also understand you cannot add any text, graphic, design, trademark, service mark or any form of a third-party’s copyright in your products without having received proper authorization from the owner(s).

You also confirm that your products do not infringe any rights of third parties, including copyrights, trademarks, the rights of publicity or privacy, nor will you libel or defame any third party, and that you have all necessary rights or permissions to add third party content into your products.

Once you submit an order on our site, you confirm you have all necessary approvals, rights and authorities to submit the order and you approve TycoonPackaging.co.uk™ to create the products on your behalf. The information, data, text, images, photographs, graphics, messages and all other content (“Content”) are the exclusive responsibility of the creator of such Content; therefore, you are accountable for all Content you send, upload, post, or otherwise communicate through our website.

You agree to adhere to all applicable laws and regulations related to online behavior and content. You agree not to use the website to upload, post or otherwise distribute Content that includes indecent, unlawful content, or Content that violates the intellectual property rights or other proprietary rights of TycoonPackaging.co.uk™ or any third party.

TycoonPackaging.co.uk™ has no control over the Content submitted by customers, and therefore, cannot guarantee the accuracy, integrity, or quality of the Content. In no instance will TycoonPackaging.co.uk™ be liable to you in any manner for any Content you may be exposed to that you may deem as offensive, indecent or objectionable.

You will be responsible for maintaining the confidentiality of your password and the security of your registered account, as well as being responsible for all orders placed or other actions which are made via your registered account.

When you, or someone who has been provided with access to your account, order a print item using your password, you give TycoonPackaging.co.uk™ the right to use the content on this site and on the printed product for the purpose of storage or printing the design worldwide and in perpetuity in a royalty-free and non-exclusive manner to reproduce, modify, sublicense, publish, display and create derivative works.

You agree that TycoonPackaging.co.uk™, and/or their respective agents, shall have the right to delete, remove or edit any content that you submit to the site that does not meet these Terms of Service or which we deem to be objectionable.

TycoonPackaging.co.uk™ reserves the right to retain content and may also be required by law to disclose content to: (a) comply with a subpoena or court order; (b) enforce our Terms of Service; (c) address claims that the content submitted by you infringes upon the rights of another party; or (d) to protect the rights, property, or personal safety of TycoonPackaging.co.uk™, the users of TycoonPackaging.co.uk™ and the general public.

DESIGN FILES

The low resolution 72 DPI design files are all that we can provide. If you want us to send high resolution version of your design files, please send an email to info@tycoonpackaging.co.uk for a quotation.

CUSTOMER SUBMITTED ARTWORK

You need to give us your artwork, designs and images in the form of CMYK with a minimum of 300 DPI. TycoonPackaging.co.uk™ cannot accept responsibility for colour changes when RGB is converted to CMYK colour mode. Likewise TycoonPackaging.co.uk™ can’t take responsibility for pictures being printed with fuzzy distortion or pixelation due to customer supplied artwork.

PROOFING & MATCHING

All print jobs require customer approval of the final art work and job specification sheet. Once an order has been placed tycoonpackaging.co.uk will send to the customer via email a final artwork proof and a job specification sheet for review by the customer.

It is the responsibility of the customer to review all details mentioned in the specification sheet, including but not limited to, delivery dates and or production speeds, and confirm that all customer requirements have been accurately noted.

Tycoon packaging co.uk shall be liable for any specifications and requirements beyond those noted in the final specification sheet. It is also the responsibility of the customer to review the final artwork proof as tycoon packaging co.uk shall be relieved from any liability for design and spelling errors which have not been identified by the customer and communicated to tycoon packaging co.uk immediately upon approval.

Upon approval of the design file and job specifications they will be sent to the production department and printed as is. Tycoon packaging co.uk shall be relieved from liability for color matching and/or ink density issues caused by screen proofs approved by the customers.

Screen proofs predict design layout, text accuracy, image proportion and placement, but do not predict color or density. Tycoon packaging co.uk will attempt to match the gradient density of each color in duo-tone. Tycoon packaging co.uk shall not be held responsible for the final appearance of a duo-tone unless the customer orders a color match proof.

Additionally, application of lamination may change or effect the appearance of the printed colors. Tycoon packaging co.uk shall not be held responsible for the final color appearance of a laminated product/s.

MATERIALS

We are using non-food grade paper/card stock in the production of all of TycoonPackaging.co.uk’s products. It is your responsibility as the customer to communicate all food grade requirements to us in written form immediately upon receipt of this quote.

If you have any specific food grade paper stock requirements, prior to ordering these items from Tycoon Packaging Ltd., you will need to notify us of them.

CUSTOMER IS RESPONSIBLE FOR PROOF AND LAYOUT APPROVAL PRIOR TO THE PRINTING.

Tycoon Packaging Limited is NOT RESPONSIBLE for any errors in any item we produce which we believe was caused by one or more of the below:

Graphics Orientation or Placement and Incorrect Font Usage

Spelling, Grammatical and Punctuation Errors

Wrong Die cuts, slits or Incorrect and Missing Folds

Finished Product Size

COLOR ACCURACY AND HARDCOPY PROOFS

We at TycoonPackaging.co.uk™ will do our best to replicate the colors from the printed ready files you submit to us. However, we are unable to guarantee color match and/or color density due to the inherent limitations of the printing process; the inherent properties of each type of printing surface.

As well as the need for neighboring images to have sufficient amounts of ink to print properly. We guarantee the color reproduction accuracy will be 90% close to the final proof you approved. Please also be aware that TycoonPackaging.co.uk can only guarantee the color reproduction for your print-ready file(s) when you purchase a hard copy proof for an additional fee.

Also, please be aware that TycoonPackaging.co.uk is not responsible for any color variation(s) that may occur between the printed ready file(s) you submit and the actual art work or product(s) those images represent.

INDEMNITY

You will be liable for defending and paying for any harm and losses TycoonPackaging.co.uk™, its directors, officers and employees may incur due to any claims made by third-party vendors with which TycoonPackaging.co.uk™ has contracted to provide content on the site, as well as any claims made by any person(s), in regards to

(i) your violation of the terms and conditions outlined herein, or

(ii) any lawsuit, claim or request made against TycoonPackaging.co.uk™ due to inclusion of any photographs, images, graphics, text or materials you added to products created using the web-based application, but were not included in the original standard site content provided with the web-based application.

ORDER CANCELLATION

TycoonPackaging.co.uk will cancel your order at the time that the order is being printed or shipped. If you have placed an order for items and those items have already been shipped, they cannot be canceled. Cancellation of orders are possible during each stage of the production process, however, cancellation charges will be applied. The customer service team will advise of cancellation charges.

1) Orders are placed on-line.

2) Orders are reworked in our design department.

3) Orders are sent to the press.

4) Orders are collected by the shipping firm and shipped

If an order is canceled in Stage 1 of the order process, there will be a cancellation charge of $15 (the cost of processing payment), plus 5% of the total value of the order (to cover bank charges and the design department). In Stage 2, there will be a minimum cancellation fee of 20% of the total order value to cover costs related to the design department.

Once an order enters into Stage 3 of the order process, we can attempt to cancel the order; however, we cannot ensure order cancellation. Should the user want to cancel an order that is currently in Stage 3, the minimum cancellation charge will be 50% of the total order value, to cover associated expenses. As soon as an order reaches Stage 4 of the order process, it cannot be canceled.

DESIGN ORDERS

Once an order is completed with a successful placement of an order on our website there are no refunds available for any orders for Design Services.

RETURNS AND REFUNDS

Since every single order is custom-made, ALL SALES ARE FINAL. If it is verified by us that we have made a mistake, then we will reprint your order. There will be NO REFUNDS OR CREDITS.

RE-PRINTS

Customer MUST notify TycoonPackaging.co.uk within 3 business days of receiving their order delivery of any defects, damage or missing items found in the delivered products. TycoonPackaging.co.uk will NOT be held accountable for any claims for defects, damage or missing items that are not submitted to TycoonPackaging.co.uk within 3 business days of receiving the delivery date.

For you to obtain replacement products, customer MUST send back (at customer’s expense) at least 99% of the original product obtained within 10 days of the date of delivery of the initial order. We WILL NOT accept ANY returns unless prior WRITTEN AUTHORIZATION TO RETURN has been given to TycoonPackaging.co.uk.

Any costs associated with expediting printing (rush printing or shipping), will NOT BE REFUNDED; this includes ANY orders that are returned due to ANY reason. NO EXCEPTIONS.

ORDER SHIPPING AND DELIVERY

TycoonPackaging.co.uk™ offers the following production options when placing an order: STANDARD (Shipping Time NOT GUARANTEED):

Typically dispatched within 10 to 14 business days after final proof approval.

Delivery time for Standard Service is not guaranteed.

PRIORITY – Guaranteed to dispatch within 8 business days:

Orders will be dispatched within 8 business days after final proof approval.

EXPRESS – Guaranteed to dispatch within 6 business days:

Free standard shipping included within mainland UK.

Orders will be dispatched within 6 business days after final proof approval

TycoonPackaging.co.uk™ ships product within 6 business days after approval of final proofs. Final proofs must be approved by 11:00 AM (EST) as any late approvals may extend shipping time by an additional business day.

TycoonPackaging.co.uk™ acts with a sense of urgency when printing and shipping your orders. Under no circumstance will TycoonPackaging.co.uk™ be liable for any losses or damages as a result of delays during the printing, shipping or delivery process of the products you have ordered.

All customers who shop at TycoonPackaging.co.uk™ accept that they will not pursue TycoonPackaging.co.uk™ for delays in deliveries caused by technical problems, bad weather, shipping company delays, customs issues in foreign countries or any other unforeseen circumstances which are outside of TycoonPackaging.co.uk’s direct control.

Delivery and shipping times are estimates based upon information supplied by our suppliers and past orders. TycoonPackaging.co.uk™ will always strive to meet the delivery schedule agreed upon. However, there may be unforeseen breakdowns in equipment, malfunctions or technical issues that may cause delays in printing or shipping.

If either of these situations occur, then any applicable rush charge or expedited fee will be waived or reimbursed. Due to possible unforeseen delays, all orders placed through TycoonPackaging.co.uk™ cannot be canceled.

All customers shopping at TycoonPackaging.co.uk™ will be responsible for paying all applicable customs duties and fees associated with the products being shipped to their location. It is the customer’s responsibility to make the necessary arrangements to clear customs for products being shipped to their destination outside the United Kingdom.

The customer is responsible for checking their package for any visible signs of damage or missing items when comparing it to the items listed on the packaging slip or invoice when they accept delivery from the delivery courier.

If the customer finds damage or missing items upon inspection of the order, the customer shall contact both TycoonPackaging.co.uk and the delivery courier immediately. The customer has three (3) business days after the date of delivery to file a claim with TycoonPackaging.co.uk ™ for any damage or missing items.

TycoonPackaging.co.uk ™ is not liable for third-party shipping errors, omissions, or damaged shipments. All products ordered through this website are typically shipped with a small number of complimentary extras. There can be rare occasions when a shipment includes less than the total amount ordered. Underage/overage allowances in the printing industry are allowed to be as high as five percent.

For this reason, if the customer requires an exact quantity of each item, we suggest ordering ten percent (10%) above the requested quantity. Additional shipping and handling costs will be incurred by TycoonPackaging.co.uk for packages that have to be reshipped because the customer entered an incorrect shipping address.

DISCLAIMER OF WARRANTY

The SITE as well as all material contained within it is “as is” and available without any express or IMPLIED WARRANTY whatsoever including without limitation, any WARRANTY of merchantability, fitness for a particular purpose, or noninfringement.

You also acknowledge that we will attempt to provide access to the SITE without interruption, however we make no WARRANTY whatsoever that the SITE shall operate without interruption or errors. REFERENCES or LINKS to product(s) or service(s) from third party COMPANIES which appear on the SITE are provided “as is” without any WARRANTY of any KIND, whether express or IMPLIED.

LIMITATION OF LIABILITY

TycoonPackaging.co.uk nor its licensors, suppliers or vendors, their officers, directors, employees or agents will be liable for damages of any kind (whether incidental, indirect, special, consequential, etc.) resulting from loss of use, data, profits, etc.

Whether or not TycoonPackaging.co.uk has been informed that such damage is possible, arising out of or in connection with your use of this Site, or TycoonPackaging.co.uk failure to provide products or services you ordered from TycoonPackaging.co.uk or its affiliates, including but not limited to: mistake, omission, virus, delay or interruption of service.

In no event will TycoonPackaging.co.uk be responsible or liable for any damage or consequences resulting from or related to your inappropriate or unauthorized use of this Site or its content.
